Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Fenix Logic Inc. (“we,” “us,” or “our”) and govern your use of Oikana, a free family calendar web application (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
Beta: everything you create is deleted every night
Oikana is a public beta — test software that we are still building. Please read this part even if you read nothing else:
- Everything you create here is deleted automatically every night. That includes your account and your login, your family and everyone in it, calendar events, tasks, shopping and meal lists, and prayer requests. The reset runs once a day, it is not reversible, and we cannot get anything back for you afterwards.
- Do not rely on the Service to store anything you need. Keep your real calendar wherever you keep it today. Treat anything you type here as something you are about to lose, because you are.
- No warranty, and no uptime commitment. The Service is provided “as is” and “as available” (section 8). We do not promise that it will be up, working, or correct at any particular moment, and we do not promise any level of availability at all.
- It may change or end at any time. We may add, change, or remove features, change how often the reset runs, or stop offering the Service entirely, without notice to you.
This section applies on top of everything below, and it wins if the two ever seem to disagree. When the beta ends we will publish updated Terms without this section and ask you to accept them.
1. Eligibility
You must be at least 18 years old (or the age of majority where you live) to create an account. Children may not create accounts. An adult account holder may add information about children in their family and is responsible for that information.
2. Your account
- Provide accurate information and keep it up to date.
- Keep your password confidential and do not share your account.
- You are responsible for activity that happens under your account, including who you invite to your family.
- Tell us promptly at support@oikana.com if you believe your account has been accessed without your permission.
3. Families and invitations
When you create a family or accept an invitation, the events, tasks, family members, and non-private prayer requests in that family are shared with its members. Only invite people you trust, and share invitation links only with the person they are intended for. Family administrators can manage members and may be able to see private prayers, as described in our Privacy Policy.
4. Acceptable use
You agree not to:
- Use the Service for anything unlawful, harmful, fraudulent, or abusive.
- Harass, threaten, or harm others, or post content that is hateful or exploitative.
- Add information about people without the authority to do so.
- Upload malware or try to disrupt, overload, or damage the Service.
- Attempt to access accounts, families, or data that are not yours, or probe or bypass security measures.
- Scrape, copy, resell, or commercially exploit the Service without our permission.
5. Your content
You own the content you add to the Service, such as events, tasks, and prayer requests (“Your Content”). You give us a limited, worldwide, non-exclusive, royalty-free license to host, store, copy, process, and display Your Content only as needed to operate and provide the Service to you and your family. This license ends when Your Content is deleted from the Service, except for residual copies in backups for a limited time.
You are responsible for Your Content and confirm that you have the right to share it. We may remove content that violates these Terms.
6. Our service
The Service is currently offered free of charge. We may change, add, or remove features, or suspend or discontinue the Service, at any time. Scripture text shown in the daily verse is provided by a third-party source and remains subject to its own terms.
7. Termination
You may stop using the Service at any time and may delete your account from Settings in the app or by contacting support@oikana.com. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (including Your Content license limits, disclaimers, limitation of liability, and governing law) will survive.
8. No warranty
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure, or that data will never be lost.
Oikana is a planning tool. Please do not rely on it as your only record of important appointments or obligations.
9. Limitation of liability
To the fullest extent permitted by law, Fenix Logic Inc. and its owners, employees, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or US $50.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
10. Indemnity
To the extent permitted by law, you agree to defend and hold us harmless from claims arising out of Your Content or your violation of these Terms.
11. Governing law
These Terms are governed by the laws of the State of Michigan, without regard to its conflict of law rules. Any dispute will be resolved in the state or federal courts located in Michigan, and you and we consent to their jurisdiction.
12. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, notify you in the app or by email. Continuing to use the Service after changes take effect means you accept the updated Terms.
